These Terms & Conditions (“Terms”) govern your access to and use of the website, services, aircraft, simulator, and facilities provided by Kodiak Aviation (“Kodiak Aviation,” “we,” “our,” or “us”), located at 4520 E Mallory Cir #117, Mesa, AZ 85215 (Falcon Field, KFFZ). By visiting our website, reserving time, or renting our aircraft or simulator, you agree to these Terms. If you do not agree, please do not use our services.

1. About Kodiak Aviation

Kodiak Aviation is an aircraft rental operation. We are not a flight school, we do not provide flight instruction, and we do not employ flight instructors. We rent our 2021 Cirrus SR20 G6 (N701YZ) and our FAA-certified simulator to qualified, approved renters. Pilots may fly solo or arrange instruction independently with a flight instructor of their choosing, subject to the approval requirements below.

2. Eligibility & Pilot Requirements

To rent and act as pilot in command of our aircraft, you must:

• Hold a valid and current FAA pilot certificate appropriate to the operation (student pilots may rent to train under the supervision and endorsements of an approved instructor);
• Hold a current and valid FAA medical certificate, or BasicMed where applicable;
• Hold a current flight review and meet all recency-of-experience requirements under the Federal Aviation Regulations (FARs);
• Complete a Kodiak Aviation checkout, which includes a minimum of five (5) hours of time in type and a checkout flight, before acting as pilot in command;
• Provide a government-issued photo ID and present your certificates, medical, and logbook for verification upon request; and
• Meet our insurance requirements (see Section 3).

We reserve the right to decline or revoke rental privileges at our sole discretion, including where a renter does not meet currency, proficiency, or safety standards.

3. Insurance Requirements

Renters insurance (non-owned aircraft insurance) is mandatory for every renter and must be in force before flight. Your policy must meet at least the following minimum coverages:

• Bodily injury and property damage liability, excluding loss of use: $250,000 per occurrence, with a $25,000 sublimit per passenger;
• Medical payments: $1,000; and
• Aircraft physical damage (hull), including loss of use: $50,000.

You must provide current proof of coverage prior to your checkout and keep it valid for the duration of any rental. You are responsible for any loss, deductible, damage, or claim not covered by your policy.

4. Reservations, Scheduling & Facility Access

Approved renters reserve aircraft and simulator time through our Flight Schedule Pro booking system. Aircraft are available 24/7 to approved renters. Each renter is issued a unique, personal hangar door access code. This code is confidential, non-transferable, and may not be shared; you are responsible for all access and activity associated with your code. Please report a lost or compromised code immediately so we can reissue it.

5. Rates, Fuel & Billing

All published rental rates are dry (fuel is not included) and are billed on recorded flight time as described on our Packages page. Rates, fees, and availability are subject to change. Discounted block-hour packages are valid for three (3) months from the date of purchase; refunds and expiration are governed by our Refund Policy. Renters are responsible for fuel, applicable taxes, landing or ramp fees, and any charges incurred away from base.

6. Overnight & Away-from-Base Rentals

Overnight and multi-day rentals are permitted by arrangement. A minimum of three (3) flight hours per night away is charged for each night the aircraft is kept away from base. If you fly more than the nightly minimum, you are billed for actual flight time; if you fly less, the three-hour minimum applies. For example, flying 1.5 hours on a one-night trip results in an additional 1.5 hours billed to meet the minimum, while flying 3.0 hours results in no additional charge.

7. Renter Responsibilities & Aircraft Care

• Operate the aircraft and simulator in accordance with the FARs, the Pilot’s Operating Handbook, placards, and any Kodiak Aviation operating limitations;
• Conduct a thorough preflight inspection and verify the aircraft is airworthy before each flight; do not fly an aircraft you believe to be unairworthy;
• Promptly report (“squawk”) any discrepancy, damage, or maintenance issue, and ground the aircraft if airworthiness is in question;
• Return the aircraft clean, secured, and hangared, with all access codes and keys accounted for;
• No smoking, vaping, or open flame in or around the aircraft, simulator, or hangar; and
• Do not operate any aircraft while impaired by alcohol, drugs, fatigue, or illness.

8. Prohibited Operations

Unless expressly authorized by us in writing, renters may not: conduct aerobatic flight, intentional spins, or maneuvers outside the aircraft’s normal category limits; operate off airport or on unimproved surfaces; carry passengers or property for hire; sublet the aircraft or allow any non-approved person to act as pilot in command; or operate outside the geographic, weather, or operational limits established at checkout. Any flight instruction received in our aircraft must be conducted by an instructor approved by Kodiak Aviation.

9. Independent Instructors

Any flight instructors referenced by Kodiak Aviation are independent third parties who are separate from us and who operate their own instruction businesses. We do not employ, supervise, or guarantee the services of any instructor. Instruction is arranged and paid directly between you and your instructor. Kodiak Aviation is not responsible for the acts, omissions, scheduling, or conduct of any independent instructor.

10. Cancellations & No-Shows

If you need to cancel or reschedule a reservation, please do so through Flight Schedule Pro or by contacting us as early as possible so the aircraft can be made available to others. Cancellations for weather, maintenance, or other safety-of-flight reasons are not penalized. Repeated late cancellations or no-shows may affect future scheduling privileges. Any applicable fees are described in our Refund Policy.

11. Damage, Deductibles & Liability

You are responsible for damage to the aircraft, simulator, or facilities arising from your operation or use, to the extent not covered by insurance, including any applicable deductibles, loss of use, and related costs. You agree to cooperate fully with any incident or insurance investigation.

12. Assumption of Risk

Aviation involves inherent risks, including the risk of serious injury, death, and property damage. By renting and operating our aircraft, or by using our simulator and facilities, you knowingly and voluntarily assume all such risks.

13. Limitation of Liability & Indemnification

To the fullest extent permitted by law, Kodiak Aviation and its owners, members, employees, and agents will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website, aircraft, simulator, or facilities. You agree to indemnify and hold Kodiak Aviation harmless from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your operations, your breach of these Terms, or your violation of any law or regulation.

14. Website Use & Intellectual Property

The content on this website — including text, graphics, logos, and images — is the property of Kodiak Aviation or its licensors and is provided for informational purposes only. You may not copy, reproduce, or use our content for commercial purposes without our written permission. Information you submit through our contact and inquiry forms is handled as described in our Privacy Policy.

15. Compliance with Law

You agree to comply with all applicable federal, state, and local laws and regulations, including the Federal Aviation Regulations, in connection with your use of our aircraft, simulator, and facilities.

16. Changes to These Terms

We may update these Terms from time to time. Updates take effect when posted on this page with a revised “Last updated” date. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of our services will be subject to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.
